NEW DELHI: In a deeply touching and extraordinary legal intervention, the Supreme Court of India declared that it "cannot but bow down" to the earnest desire of a special-needs child, modifying the terms of a prior divorce settlement to grant exclusive custody to the mother and permit the child to take her stepfather's surname.

A bench comprising Justices J.B. Pardiwala and K. Vinod Chandran delivered the ruling, prioritizing the holistic well-being, psychological stability, and dignity of the young girl. The bench underscored that the child had developed a profound emotional attachment to her stepfather—who lives with and cares for her—and had frequently wondered aloud why she could not bear the name of the father figure residing with her, just like her friends did.

Overriding Previous Settlement Terms

The case originated from a 2018 memorandum of settlement that led to a mutual consent divorce decree granted by a Family Court in Bengaluru in early 2019. Under the original terms, the estranged parents agreed to joint custody and visitation rights for the biological father. Additionally, an undertaking was recorded requiring the mother to raise the child according to the Islamic tenets of the biological father, given their interfaith background.

However, subsequent developments, remarriages, and extensive direct interactions between the bench, the parents, and the child compelled the Supreme Court to rewrite these provisions. Invoking its extraordinary powers under Article 142 of the Constitution, the apex court upheld the decree of divorce but set aside the clauses dictating joint custody, visitation rights, and religious upbringing commitments.

Centering the Child’s Best Interests

Noting the mother's plea regarding the practical unsustainability of the former arrangements and the child's evident anxiety and apprehension toward her biological father, the court concluded that preserving the old framework would subject the child to persistent trauma.

"She questions the mother as to why she is not given the name of the father who resides with them and looks after her, as is the case with her friends. We cannot but bow down to the desire expressed by the child... especially in the peculiar circumstances coming out in this case," the bench observed.

Consequently, the top court granted the mother exclusive custody and authorized her to modify school transcripts, citizenship documents, and other official identification records to align the child's identity with her current household and care environment.

Closure of Criminal and Contempt Proceedings

To secure a peaceful future free from legal friction, the Supreme Court also quashed a pending POCSO and criminal case registered against the biological father, closed related civil contempt proceedings concerning visitation disputes, and officially revoked the biological father's visitation rights.

While acknowledging the deep-seated apprehensions implanted in the child's mind, the bench expressed hope that these misgivings would eventually fade, emphasizing, however, that forcing immediate contact under current conditions would run directly counter to her welfare
